Council tax bailiffs: fees, powers and their limits

Enforcement agents add fixed fees at each stage and have real powers — but the limits on those powers are just as real, and knowing them changes the encounter.

Before visiting, an enforcement agent must send a notice of enforcement giving at least 14 clear days — extendable to 28 days, where an authorised debt adviser asks for the extension. The compliance stage adds £79; a visit adds £247, plus a percentage of debt above £1,900. For council tax, agents cannot force entry to your home on a first visit, and everything changes depending on whether they have ever been let in.

The fee ladder

£79 is added when the case reaches the agent (the compliance stage — the notice of enforcement period). £247 is added if a visit happens, plus 7.5% of any debt above £1,900. A sale stage adds more. The arithmetic is the argument: paying or arranging during the 14-day notice window — with the council directly where possible — is hundreds of pounds cheaper than opening the door. The wider rules on entry, what can be taken and how enforcement is stopped are in the bailiff guide.

Powers and their limits

Agents can visit between 6am and 9pm, unless a court order says otherwise. For council tax they cannot break into your home; entry is by a door someone aged 16 or over opens to them, and they must leave without making enquiries if the only person there is a child. A vehicle can be taken from outside your home, your workplace or a public road — which is why the car, not the door, is usually the real exposure. You do not have to let them in, and saying so through the door, calmly, is lawful.

Stopping it

Payment or an arrangement with the council can pull the case back. Vulnerability — illness, disability, recent bereavement, children alone — obliges agents to pause and refer. Breathing Space halts enforcement for 60 days while you take advice. If a visit is imminent, the bailiff-at-the-door guide covers the encounter minute by minute.
